These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and StreamHex ("we", "us", or "our"). By creating an account, accessing, or using StreamHex, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
If you are using StreamHex on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
StreamHex is a Discord bot and dashboard that provides automated notifications and server management tools. The Service currently includes the following features:
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We may also impose limits on certain features or restrict access to parts or all of the Service without liability.

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized access to your account. StreamHex is not liable for any loss or damage arising from your failure to protect your account.
You agree to use StreamHex only for lawful purposes and in accordance with these Terms. You specifically agree NOT to:

StreamHex is currently in closed beta testing. As a beta participant, you acknowledge and agree that:
Beta access is by invitation only. You may not transfer, sell, or share your beta access with others.
Certain features of StreamHex are available only to Premium subscribers, including:
Payment Processing: All payments for Premium subscriptions are processed exclusively through Discord's built-in monetization platform. StreamHex does not collect, store, or process any payment or billing information directly. By purchasing a Premium subscription, you also agree to Discord's Terms of Service and its payment and subscription policies.
Pricing and Billing:
Cancellation: You may cancel your Premium subscription at any time directly through Discord — click on the StreamHex bot in your server, open its profile, and select Manage Subscription. Your Premium features remain active until the end of the current billing period. No partial refunds are issued for unused time within a billing period.
Refund Policy: Since all payments are processed by Discord, refund requests must be directed to Discord Support. StreamHex has no access to your payment data and cannot issue refunds directly. In cases of significant technical failures on our part that prevent the service from functioning entirely, you may contact us at contact@streamhex.com and we will assess your request on a case-by-case basis.
Right of Withdrawal — Exclusion for Digital Services (§ 356 Abs. 5 BGB): In accordance with § 356 Abs. 5 of the German Civil Code (BGB), the statutory right of withdrawal does not apply to this subscription. Premium access is a digital service that is made available immediately upon purchase. By completing the purchase through Discord, you expressly consent to the immediate commencement of the service and acknowledge that you thereby waive your right of withdrawal.
When you authorize StreamHex to access your Discord server, you grant the following permissions:
StreamHex will only use these permissions for the intended functionality of the Service. You may revoke these permissions at any time by removing the bot from your Discord server.
StreamHex, including its name, logo, design, code, and documentation, is owned by StreamHex and protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.
You retain ownership of any custom notification messages or configurations you create. However, by using the Service, you grant StreamHex a worldwide, royalty-free license to use, reproduce, and display your configurations solely for the purpose of providing the Service.
StreamHex integrates with third-party services including Discord and Twitch. Your use of these services is subject to their respective Terms of Service:
We are not responsible for the availability, content, or practices of third-party services. Any interactions with third-party services are solely between you and the third party.
While we strive to maintain high uptime, we do not guarantee uninterrupted access to the Service. The Service may be unavailable due to:

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STREAMHEX SHALL NOT BE LIABLE FOR:
IN ANY EVENT, STREAMHEX'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO STREAMHEX IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.
You agree to indemnify, defend, and hold harmless StreamHex, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising from:
Termination by You: You may terminate your account at any time by disconnecting StreamHex from your Discord account or contacting support.
Termination by Us: We reserve the right to suspend or terminate your account immediately, without prior notice, if:
Effect of Termination: Upon termination, your right to use the Service will immediately cease. We may delete your account data in accordance with our data retention policy. Termination does not relieve you of any obligations incurred prior to termination.
These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions. If you are a consumer residing in the EU, you additionally benefit from any mandatory protective provisions of the law of your country of residence.
Informal Resolution: Before filing any formal legal action, you agree to first contact us to attempt to resolve any dispute informally. We will make good faith efforts to resolve disputes amicably.
Arbitration: Any disputes that cannot be resolved informally shall be resolved through binding arbitration, except where prohibited by law. You agree to waive your right to a jury trial or to participate in a class action lawsuit.
We may update these Terms from time to time to reflect changes in our practices, technology, or legal requirements. When we make changes:
Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

StreamHex shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
